Terms and conditions
These terms explain your rights and responsibilities when you use Golden Hour to host an event, upload photos or participate.

1. Agreement
These Terms form an agreement between the account holder and [LEGAL BUSINESS OR PROPRIETOR NAME], trading as Golden Hour. By creating an account or buying a service, the account holder agrees to these Terms and acknowledges the privacy policy. If these Terms are not accepted, do not create an account, buy a service, or upload content.
2. Who may use the service
An account holder must be at least 18 years old and legally able to enter a contract. A parent or legal guardian may create and manage an account for a person under 18. A child must not create an account, accept these Terms, buy a service, or provide face-matching data independently.
A person using Golden Hour for an organization confirms that they have authority to act for that organization. Account and sign-in details must be accurate and kept secure.
3. What Golden Hour provides
Golden Hour helps hosts collect event media and helps participants find likely photographs using configured matching methods. Availability, processing time, match accuracy, and delivery depend on image quality, connectivity, event settings, participant information, and third-party services. Face and other automated matches are suggestions and are not guaranteed to be complete or correct.
4. Host responsibilities
An event host is responsible for:
- Having a lawful reason to share event access, collect participant details, and photograph or record the event.
- Giving participants clear event-specific information before collecting media or face-matching data.
- Obtaining parental or guardian permission where children may appear or participate.
- Using access links, shared galleries, recognition settings, moderation, delivery, and retention responsibly.
- Responding to participant questions and reports and complying with applicable venue, employment, education, and event rules.
5. Content and permissions
A user keeps their rights in content they upload. The user gives Golden Hour a limited, non-exclusive licence to host, copy, transform, analyze, display, and deliver that content only as needed to operate, secure, and support the service and the relevant event.
The uploader confirms that they have the rights and permissions needed to upload the content and allow this use, including permission relating to copyright, privacy, publicity, and people depicted. Do not upload confidential, unlawful, infringing, abusive, sexually exploitative, or dangerous material.
6. Face matching
Face matching requires a participant-facing notice and express consent. It may produce false matches or miss photographs. Users must not use Golden Hour for policing, surveillance, employment decisions, eligibility, credit, insurance, healthcare, or any other high-impact decision. A host must provide a suitable alternative when consent is not valid or cannot be freely given.
7. Acceptable use
Users must not:
- Access another account, event, gallery, or link without permission.
- Probe, scrape, overload, reverse engineer, bypass limits, or interfere with security or service operation.
- Upload malware or content designed to exhaust image, archive, storage, or processing resources.
- Use recognition outputs to identify strangers outside the intended event.
- Resell or misrepresent the service without written permission.
8. Purchases and payment
Golden Hour may sell one-time event services. The price, included usage, taxes, event date, and any special conditions must be shown before payment or stated in the accepted order or invoice. Users must provide accurate billing information and may not initiate a payment they are not authorized to make.
Photo allowances cover processing and viewing across one event. Any contributor may upload photos. Extra originals may be saved while waiting for the host to purchase more processing capacity; they are not charged automatically. Credits are allocated in upload order and are not restored when included photos are deleted. Waiting originals follow the event’s retention settings. A purchase does not extend retention. Custom quantities and their rounded allowance are shown before payment.
Refunds are governed by the refund and cancellation policy and any non-excludable consumer rights. There is currently no recurring subscription unless a separate written order expressly says otherwise.
9. Service changes and availability
We may maintain, secure, improve, suspend, or discontinue features. We will try to give reasonable notice when a planned change materially affects a paid event. Emergency changes may be made without advance notice to protect users, data, or infrastructure.
10. Suspension and termination
We may restrict or suspend access where reasonably necessary to address unlawful use, security risk, non-payment, infringement, or a material breach of these Terms. Where practical, we will explain the reason and provide a way to appeal. Users may stop using the service and use available privacy controls to request deletion.
11. Intellectual property
Golden Hour software, branding, interface, and original documentation belong to the operator or its licensors. These Terms do not transfer those rights. Feedback may be used to improve the service without identifying the person who provided it.
12. Third-party services
The service depends on infrastructure, storage, communications, authentication, and payment providers. Their terms may apply when a user deliberately uses those services. Golden Hour is not responsible for a third-party service beyond the extent required by applicable law, but remains responsible for its own obligations when it appoints a data processor.
13. Consumer rights, disclaimers, and liability
Nothing in these Terms excludes a guarantee, remedy, or liability that cannot lawfully be excluded. Subject to that rule, the service is provided with the features and limits described at purchase, and we do not promise uninterrupted availability or perfect recognition, delivery, or preservation.
To the extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable. Any contractual liability cap will not apply to fraud, wilful misconduct, breach of confidentiality, infringement, personal-data obligations, or amounts that cannot legally be limited.
14. Governing law and disputes
These Terms are governed by the laws of India. Courts with lawful jurisdiction in [CITY AND STATE, INDIA] may hear disputes, without limiting a consumer's right to approach a consumer commission, regulator, or other forum available under law.
Please contact the Grievance Officer first so the issue can be investigated. We aim to acknowledge complaints within 48 hours and resolve them within one month.
15. Changes
Material changes will be presented before they apply. Continued use alone will not be treated as consent where law requires a fresh affirmative choice.
